Electronic Delivery of e-Statement/e-Notices/e-Alerts
Unless you consent, you have the right to receive all required disclosures in paper or non-electronic form. By accepting the “New Peoples Bank Inc. Electronic Account(s) Disclosure Agreement”, you consent and agree that New Peoples Bank Inc. may provide certain disclosures, notices and alerts to you in electronic form, in lieu of paper form, including electronic delivery of e-Statement/e-Notices/e-Alerts for your New Peoples Bank Inc. account(s).

Consent for Electronic Delivery of Statements
Your consent to receive e-Statement/e-Notices covers the periodic statements you are provided in connection with your New Peoples Bank Inc. account(s). By using e-Statement/e-Notices/e-Alerts, you accept and agree to be bound by the general terms and conditions governing e-Statement/e-Notices/e-Alerts, including without limitation all the terms and conditions in this Agreement. You agree to be bound by any and all laws, rules, regulations and official issuances applicable to e-Statement/e-Notices/e-Alerts now existing or which may hereafter be enacted, issued or enforced, as well as such other terms and conditions governing the use of other facilities, benefits or services that New Peoples Bank Inc. may from time to time make available to you in connection with e-Statement/e-Notices/e-Alerts.
New Peoples Bank Inc. has absolute discretion to make e-Statement/e-Notices/e-Alerts available to you. Further, New Peoples Bank Inc. has the discretion from time to time and upon giving notice to you to modify, restrict, withdraw, cancel, suspend or discontinue e-Statement/e-Notices/e-Alerts without giving any reason and you understand that by using e-Statement/e-Notices/e-Alerts after any modification or change has been effected, you would have agreed to such modification or change. All future statements/notices for that account will be e-Statement/e-Notices/e-Alerts which you will access with a password. You will have the ability to review, print, and copy/download your periodic account statements/notices from your email e-Statement/e-Notices/e-Alerts. Each month we will send an email e-Statement/e-Notices to you, which is password protected. As long as you keep the original e-Statement/e-Notices from New Peoples Bank Inc., you will be able to view your e-Statement/e-Notices. It will also be available for viewing for a period of twenty-four (24) months (or such period as decided by New Peoples Bank Inc. and notified to you) from the applicable statement date, through your Online Banking account.

Consent for Electronic Delivery of Notices
Your consent to receive e-Statement/e-Notices/e-Alerts covers any notice or other type of communication provided to you, pursuant to the terms of this Agreement. We will send all notices, attachments, and/or documents via e-mail to the last known e-mail address provided by you. You agree to notify us promptly of any change of your e-mail address.

New Peoples Bank Inc. e-Statement/e-Notices/e-Alerts Procedures
To enroll your account(s) for e-Statement/e-Notices/e-Alerts access, simply complete the following enrollment form. You can also enroll from the online banking during your first log in session. If you chose to select “Ask me Later” or the “Decline” option during your first log in session you can enroll later by selecting the “Options” link and selecting the accounts available for the e-Statement/e-Notices/e-Alerts from the “E-Statements Enrollment Section”. You will receive your e-Statement/e-Notices/e-Alerts email shortly after the end of each statement period. In order to access your e-Statement/e-Notices/e-Alerts, you must type in the password that was provided to you by New Peoples Bank Inc. Your e-Statement/e-Notices/e-Alerts for your next statement cycle should be available for viewing through your online banking account the business day after your statement close date.

Change of Mailing Address, Email Address, and Other Information
You agree to notify us immediately of any change in your mailing address, e-mail address or other particulars relevant to this Agreement. To notify us of your e-mail address change, please visit at your nearest branch location and complete the applicable form or a customer service representative will give you your password when the form is completed.

Log in to New Peoples Bank Inc. go to “User Options”, select “E-mail Address”, and enter your new e-mail address in the “Email Address” field. Please note that you must provide us with an e-mail address in order to use the e-Statement/e-Notices/e-Alerts service.

Joint Accounts
If your New Peoples Bank Inc. account is owned jointly with another person, either one of you may consent to receive electronic disclosures and e-Statement/e-Notices/e-Alerts and that person’s election to access e-Statement/e-Notices/e-Alerts shall apply to both of you. New Peoples Bank Inc. will automatically turn off the paper statement for the account(s) once an e-Statement/e-Notices/e-Alerts form has been completed.

You agree that New Peoples Bank Inc. shall not be held liable if you are unable to gain access to your email, the website or New Peoples Bank, Inc. Online Banking system from time to time or if your account has been blocked or deactivated. You understand that some or all of the e-Statement/e-Notices/e-Alerts services and/or other New Peoples Bank, Inc. system services may not be available at certain times due to maintenance and/or computer, communication, electrical or network failure or any other causes beyond New Peoples Bank, Inc.’s control. You understand the importance of your role in preventing misuse of your accounts and you agree to promptly examine your e-Statement/e-Notices/e-Alerts for each of your New Peoples Bank, Inc. account(s) as soon as you can access it. You must report any errors or discrepancies in accordance with our Account Disclosure as provided to you and with applicable law.

Your e-Statement/e-Notices password can be changed by you at any time by contacting your local branch and completing the applicable form. Your User ID and password that are used to access Online Banking services should be kept confidential. The password must be changed at least every ninety (90) days. You are responsible for keeping your password, account numbers and other account data confidential.

Hardware and Software Requirements
Below are the hardware and software requirements for access to and retention of the information being provided to you electronically;
We will notify you whenever we change or revise these requirements:

  • Internet Access
  • An Internet browser that supports 128-bit encryption
  • A certified/supported browser
  • Adobe Acrobat Reader (which may be downloaded at no charge on the internet)

Change in Terms
The Bank reserves the right to change the terms and conditions of this agreement at any time, which includes the addition and deletion of e-Statement/e-Notices/e-Alerts services.

Right to Withdraw Consent
You have the right to withdraw your consent to have your e-Statement/e-Notices/e-Alerts provided in an electronic form by contacting your local branch. We will then discontinue e-Statement/e-Notices/e-Alerts service for that account(s) and you will receive paper statements for subsequent statement periods. If you want to receive e-Statement/e-Notices/e-Alerts again after you have withdrawn your consent for e-Statement/e-Notices/e-Alerts, you must complete the consent process again and reconfirm your ability to access e-Statement/e-Notices/e-Alerts.

Disclaimer of Warranty and Limitation of Liability
We make no warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose, in connection with the e-Statement/e-Notices/e-Alerts provided to you under the Agreement. We do not and cannot warrant that the e-Statement/e-Notices/e-Alerts service will operate without error, or that the e-Statement/e-Notices/e-Alerts service will be available at all times. Except as specifically provided in this Agreement, or otherwise required by Law, you agree that our officers, directors, employees, agents or contractors are not liable for any indirect, incidental, special or consequential damages under or by reason of any services or products provided under the Agreement or by reason of your use of the e-Statement/e-Notices/e-Alerts service, including loss of profits, revenue, data or use by you or any third party, whether in an action in contract or tort or based on a warranty or any other legal theory.
New Peoples Bank Inc. makes no warranty that:

  • The service will be uninterrupted, timely, secure or error-free
  • The service will meet your requirements
  • The results that may be obtained from the use of the service will be accurate or reliable
  • The quality of any products, services, information or other material purchased or obtained by you through the service will meet your expectations
  • Any errors in the software will be corrected

New Peoples Bank Inc. shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from:

  • The use or the inability to use the service
  • The cost of procurement of substitute goods and services resulting from any goods, data information or services purchased from the service
  • Unauthorized access to your transmission
  • Unauthorized alteration of your data
  • Any other matter relating to the service
  • The inability to produce an original check
